ONLINE AUCTION - RULES

1 - Choose one of the painting listed at the VIRTUAL AUCTION area on PINTURAESPIRITA.COM.BR website and fill out the registration form corresponding to the chosen painting.

2 – You can bid on one or more paintings. Be aware that every bid is valid and that you will be responsible for paying off every winning bids, not being allowed to give up on the unwon bids.

2.1 - The winner will be the one who offered the highest price for the painting, based on the minimum bid stipulated in the painting's description. In the event of a tie, the one who sent first will be the winner.

3 - To be considered valid, bids must be made within the deadline established at the VIRTUAL AUCTION on the webpage www.pinturaespirita.com.br.

4 - The winner of the auction will receive an email from SBBM (Sociedade Beneficente Bezerra de Menezes) informing about the result and the VALUE corresponding to the winning bid. From that date on, the winner will have 3 working days to make the deposit into the bank account provided and must send the scanned deposit receipt, with the payment voucher.

4.1 - Winners residing outside the city of CAMPINAS (in other cities, states or countries) must observe the rules contained in item 8 and its sub-items.

5 - The total value of the deposit is the sum of the bid value offered plus the cost of the painting’s shipping via the chosen way of freight and any taxes applicable in case of shipping to other countries (see section 8 et seq.). For choosing the shipping method, firstly we will consider the GUARANTEE OF SAFETY TRANSPORTATION and, secondly, THE LOWEST COST FOR TRANSPORTATION.

6 - If you do not deposit your payment on the required period, your bid will be disregarded and the painting will not be sent to you.

7 - People from outside Brazil must be carefull to the deadlines and the corresponding time zone as the end of the deadline corresponds to Brazilian time zone.

8 - The winner who resides outside of Campinas (another city, another state and another country) must pay the amount of the bid plus the international transport costs, using Vale Postal dos Correios service or must make a bank deposit to the agency and current account indicated by SBBM (Sociedade Beneficente Bezerra de Menezes), proving payment via email.

8.1 – The winner residing outside Campinas (another city, another state and another country), the obligations to prove payment the copy of the receipt must be fulfilled within 5 working days, from the date of being aware of the result that will be sent via email.

8.1.1 – For bidders residing in countries that tax the entry of paintings from abroad, the value of the tax on the shipment of the painting must be paid by the bidder, and must be included in the total to be paid for the painting acquired from SBBM (Sociedade Beneficente Bezerra de Menezes), through the payment voucher sent by the bidder by email.

8.2 – The winner residing outside of Campinas (another city, another State and another country) has a period of 30 days after being notified to decide how they intend to receive the purchased paintig, under penalty of, if they fail to do so, accept the method in which SBBM choose for shipping, bearing the respective costs that will be indicated.

8.3 – SBBM WILL NOT GIVE DISCOUNTS ON THE AMOUNT TO BE PAID BY THE BIDDER, even if the bidder requests that the painting to be sent without the frame. In this case, the frame will remain in the assets of SBBM, which will be able to use it in future auctions of other paintings.

8.4 – If the bidder requests that the Institution postpone the shipment of the painting after the 30 days in clause 8.2, SBBM IS NOT RESPONSIBLE for events that may damage the painting, as it will need to be constantly moved inside the institution because os its regular operating routines, nor for fortuitous accidents caused by rain, humidity, floods, fires, renovations or other types of occurrences, since the institution (SBBM) does not have the proper conservation, surveillance and protection structure of a museum.

8.5 – In the case shipping is not possible, under the terms of clause 8.4, SBBM may:

A – Return the nominal value deposited by the winning bidder, through deposit into the account indicated, without interest or monetary corrections.

B - Offer the bidder the corresponding credit for the acquisition of another painting to be produced in a future event.

8.6 – The winner and auction participants are aware that SBBM is a charitable institution that does not have salaried employees for any type of service, with the volunteers responsible for the remittance/dispatch/value consultation/personal attendance/, although extremely careful and diligent, are VOLUNTEERS who carry out such tasks at their available times and within their personal possibilities.

8.7 – SBBM RESERVES THE RIGHT TO UNILATERALLY CANCEL THE TRANSACTION with the nominal return of the amount deposited by the winning bidder, if he/she does not remain within the limits of civility, respect and polite treatment, as well as does not indicate the data and ways to carry out the shipment of the work, or expresses itself in a confusing, nebulous, or contradictory manner regarding the details necessary to carry out its shipment.

9 - Once the bid has been sent, it binds the bidder by the terms contained therein.

10 - Anyone who does not behave properly or respect the terms presented here will be excluded from the current auction and prevented from participating in future virtual auctions.

11 - The winner of each auction is aware that the resources transfered to the Institution are ENTIRELY intended to meet the basic needs of approximately 130 needy families, within the charitable objectives of SBBM.
